AN ACT concerning the Kansas public employees retirement system and systems thereunder; relating to lump-sum death benefit; amending K.S.A. 1996 Supp. 74-4989 and repealing the existing section. Be it enacted by the Legislature of the State of Kansas: Section 1. K.S.A. 1996 Supp. 74-4989 is hereby amended to read as follows: 74-4989. (1) (a) Except as provided in (b) and (c), upon the death of a retirant, the board of trustees of the Kansas public employees retire- ment system shall pay a lump-sum death benefit to the retirant's bene- ficiary which shall not exceed $4,000 for such retirant, less any amount payable for funeral benefits under the applicable provisions of any local police or fire pension plan, as defined by subsection (c) of K.S.A. 12-5001 and amendments thereto. (b) Notwithstanding the provisions of K.S.A. 74-4923 and amend- ments thereto, any amounts owed the system shall be deducted from such lump-sum death benefit. (c) Any retirant may make application to the system in such form and manner as provided by the system to withdraw such retirant's lump-sum death benefit in whole or in part prior to such retirant's death for the purpose of the purchase or reimbursement of the purchase of insurance or contracts of the burial or funeral benefit type or prearranged funeral agreements, contracts or plans regardless of whether such purchase was made before the effective date of this act. Such retirant shall certify to the system that such retirant shall use or has used the withdrawal for the purposes provided by this section. The amount of such withdrawal shall be based on the actuarial value of such retirant's lump-sum death benefit at the time of the withdrawal using the retirant's attained age and the actuarial assumptions and tables currently in use by the retirement sys- tem. Any amounts withdrawn by the retirant as provided in this subsec- tion shall not be paid as provided in subsection (a) to the retirant's ben- eficiary upon the death of the retirant. Any claims for such amounts by the retirant's beneficiary are null and void. (2) As used in this section, ``retirant'' means any person who is a member or special member of the Kansas public employees retirement system, the Kansas police and firemen's retirement system, the state HB 2395

 3    Sec. 2.  K.S.A. 1996 Supp. 74-4989 is hereby repealed.
 4    Sec. 3.  This act shall take effect and be in force from and after its
 5  publication in the statute book.
