            9             AN ACT concerning recorded information gathered or maintained by
10             state agencies; prescribing powers, duties and functions for the joint
11             committee on computers and telecommunications; amending K.S.A.
12             46-2102 and repealing the existing section.
14       Be it enacted by the Legislature of the State of Kansas:
15           Section 1. K.S.A. 46-2102 is hereby amended to read as follows:
16       46-2102. In addition to other powers and duties authorized or prescribed
17       by law or by the legislative coordinating council, the joint committee on
18       computers and telecommunications shall:
19           (a) Study the use by state agencies and institutions of computers,
20       telecommunications and information technologies;
21           (b) review new governmental computer hardware and software ac-
22       quisition, information storage, transmission, processing and telecommu-
23       nications technologies proposed by state agencies and institutions, in-
24       cluding budget estimates for implementation of the same, and make
25       recommendations thereon to the ways and means committee of the sen-
26       ate and the committee on appropriations of the house of representatives;
27           (c) study the progress and results of all newly implemented govern-
28       mental computer hardware and software, information storage, transmis-
29       sion, processing and telecommunications technologies of state agencies
30       and institutions; and
31           (d) examine existing laws regarding public records to determine
32       whether adequate safeguards exist to preserve the integrity of and to con-
33       trol access to personal information gathered or maintained by state agen-
34       cies;
35           (e) examine the policies, procedures and rules and regulations of state
36       agencies regarding public records that contain personal information and
37       determine whether record custodians are implementing such safeguards
38       to adequately safeguard the personal information in such public records;
39           (f) determine and review the justification for the scope and extent of
40       personal information gathered or maintained by state agencies;
41           (g) examine public records systems of other states to identify best
42       practices that might be used as models in Kansas;
43           (h) develop legislation and make other recommendations, including

  1       recommended standards, regarding gathering and preserving the integ-
  2       rity of and authorized access to personal information gathered or main-
  3       tained by state agencies;
  4           (i) monitor state agency actions and activities regarding the gathering
  5       or maintaining of personal information, which may include requesting
  6       audits under the legislative post audit act of such state agency actions and
  7       activities; and
  8           (j) make (1) an annual report to the legislative coordinating council
  9       as provided in K.S.A. 46-1207 and amendments thereto, (2) a special
10       report each January on the gathering and maintaining of personal infor-
11       mation by state agencies to the governor, the chief justice of the supreme
12       court and each standing committee of the legislature; and (3) such other
13       special reports to committees of the house of representatives and senate
14       as are deemed appropriate by the joint committee.
15           Sec. 2. K.S.A. 46-2102 is hereby repealed.
16           Sec. 3. This act shall take effect and be in force from and after its
17       publication in the statute book.
