A public hearing will be conducted by the Kansas State Board of Mortuary Arts at 11:45 a.m. Thursday, October 11, 2007, in the Jayhawk Tower Building, Room 904, 700 SW Jackson St., Topeka, to consider the approval and adoption of two amended regulations of the Kansas State Board of Mortuary Arts.

Any individual with a disability may request accommodation in order to participate in the public hearing and may request the proposed regulation and economic impact statement in an accessible format. This 60-day notice period prior to the hearing constitutes a public comment period for the purpose of receiving written public comments on proposed administrative regulations. All interested parties may submit written comments prior to the hearing to Mack Smith, Executive Secretary, Kansas State Board of Mortuary Arts, 700 SW Jackson St., Room 904, Topeka, 66603-3733. All interested parties will be given a reasonable opportunity at the hearing to express their views orally in regard to the adoption of the proposed regulations. During the hearing, all written and oral comments submitted by interested parties will be considered by the board as a basis for approving, amending and approving, or rejecting the proposed regulations. In order to give all parties an opportunity to present their views, it may be necessary to request that each participant limit any oral presentation to five minutes. A summary of the proposed new and amended regulations and the economic impact follows:

K.A.R. 63-2-26 Assistant funeral director’s license examination. This new regulation includes information on a new examination for licensure.

K.A.R. 63-2-26 Economic Impact Statement Amendments would result in no increased income to the board. While the proposed fee of $50 would constitute new income, the number of applicants for licensure should decrease. Other governmental agencies and consumers would not be effected by this regulation.

K.A.R. 63-4-1 Payment of fees. This regulation is being amended to include the assistant funeral director examination fee.

While the proposed fee of $50 would constitute new income, the number of applicants for licensure should decrease. Other governmental agencies and consumers would not be effected by this regulation.
