I.        The Investigative Committee (IC) of the board met to discuss and make recommendations to the Board on open complaints. Those in attendance included: Charles R. Smith, Overland Park, Consumer, William H. “Bill” Young, Lake Quivira, Licensee, the Board’s Litigation/Prosecuting Assistant Attorney General Steve Phillips, and Executive Secretary Mack Smith. Actions from this committee meeting are contained in these minutes.

                                                                                                                                                                                                                                                                                                        

Thursday, July 8, 2010:

 

II.       The regularly scheduled meeting of the Kansas State Board of Mortuary Arts (KSBMA) was called to order by President Fred G. Holroyd.

 

Roll call by Executive Secretary Mack Smith found the following board members in attendance: President Fred G. Holroyd, Topeka, Licensee; Vice President William H. “Bill” Young, Lake Quivira, Licensee; Board Member Barry W. Bedene, Arma, Licensee; and Charles R. Smith, Overland Park. The board’s Executive Secretary, Mack Smith and Assistant Attorney General Camille Nohe were in attendance. Consumer Board Member Diane Minear, Tonganoxie, was unable to attend the meeting.

 

The board congratulated President Holroyd on his three-year reappointment to the board by Governor Mark Parkinson.

 

The board noted this meeting’s tentative agenda that is displayed on the agency’s website at: http://www.kansas.gov/ksbma/ under the heading of Agency Information and Tentative Board Agenda.

                                                                                                                                                                                                                                                                                                           

 

(Bedene-Young) To approve a final agenda for this meeting. Carried.

 

 

The board decided to eat lunch following conclusion of the meeting at the restaurant downstairs in the Jayhawk Tower.

 

(Bedene-Young) To adopt the April 8, 2010 regularly scheduled board meeting minutes as amended. Carried. These minutes will be signed by President Holroyd and Executive Secretary Smith then displayed on the board’s website.

 

The board reviewed results of the written funeral directors’ examination administered on April 8, 2010 noting that 80.0% (eight of ten applicants) were successful.

 

The board reviewed results of the written assistant funeral directors’ examination administered in May, June and July of 2010 noting that 100% (five of five) of all applicants were successful. Since the law requiring examination was enacted on February 8, 2008, 47 out of 55 applicants (85.4%) have successfully passed this examination.

 

The board reviewed the ‘List of Licensure Applicants’ scheduled to interview with the board at this meeting, noting the following applicants scheduled to meet with the board: five (5) embalmer-funeral director applicants, one (1) funeral director applicant, one (1) embalmer applicant, and three (3) reciprocal (Illinois, Florida, Missouri) embalmer-funeral director applicants. The two (2) applicants that failed the April funeral director examination have applied to retake today’s funeral directors’ examination–making a total of eleven (11) applicants scheduled to be administered the written funeral directors' examination in conjunction with this meeting.

                                                                                                                                                                                                                                                                                                        

III.      The board reviewed individual applications for embalmer and funeral director licensure along with the executive secretary’s summations of the applicant’s apprentice and supervising licensee progress reports. Applicants for licensure will be interviewed later in this meeting. Funeral director applicants will be administered the written funeral directors' examination by Funeral Home/ Crematory Inspector Francis Mills at 1:30 p.m. this afternoon in the Florentine Room of the Jayhawk Tower.

 

All quarterly progress reports of embalmer/funeral director apprentices and supervising licensees were summarized by the executive secretary with copies of the individual reports available for board review.

 

The second quarter progress reports for a funeral director apprentice were reviewed and discussed.           The Board’s Investigative Committee, which is composed of Board Members

Young and C. Smith with legal assistance provided by Assistant Attorney General (litigation) Steve Phillips and administrative assistance by Executive Secretary Smith, met Wednesday, July 7, 2010 at 3:00 p.m. to discuss and make recommendations on open complaints. Investigative Committee recommendations are included with the following individual complaints.

 

#09-10–No action necessary at this time. The file remains open until a criminal case involving a cemetery owned by the individuals who also own the funeral home has been finalized to ensure no involvement by a licensed funeral director that would warrant any board action.

 

#09-50–Following review of all documentation and correspondence: (Bedene-Holroyd) To close the file. Carried. The licensee’s funeral director’s license has been publicly censured with censure being placed on the KSBMA web site. The complaint involved failure of the licensee to provide the legal next of kin a signed written price statement as required by KAR 63-3-17(c). The consumers were notified of the action taken against the licensee.

 

#10-04–Following review of correspondence: (Bedene-Holroyd) To close the file. Carried. The licensee was notified to pay closer attention to his advertisements to avoid any similar instances in the future. The complaint involved fraudulent, deceptive and misleading advertising.

 

#10-05–Following review of correspondence: (Bedene-Holroyd) To close the file. Carried. The licensee was notified to pay closer attention to detail in order to avoid any future clerical errors from occurring. The complaint involved the funeral home putting incorrect information on a tag identifying the cremated remains of a loved one due to clerical error.

 

#10-06–(Young-C. Smith) To adopt the recommendations of the Investigative Committee that quicker action on behalf of the funeral home would have avoided the situation from occurring. Carried. The complaint involves the failure to the funeral home to provide the family with a refund in an appropriate amount of time.

 

 #10-07–Following review of correspondence: (Bedene-Holroyd) To close the file. Carried. The licensee was advised to take appropriate measures in order to ensure compliance with the provision in the Federal Trade Commission’s Funeral Rule requiring disclosure of cash advance items in which the price being charged by the funeral home is not the same as the cost to the funeral home as well as Kansas law involving fraudulent/deceptive/misleading advertising. The individual filing the complaint will be advised that any pay discrepancies should be brought to the attention of the Kansas Department of Labor. Carried. The complaint involves the funeral home’s General Price List and charges to families of Cash Advance Items and hours worked/services provided by a former employee of the funeral home.

#10-10–(Young-C. Smith)To adopt the recommendations of the Investigative Committee of no violations and to close the file. Carried. The complaint involves concerns with the number and amount of prefinanced funeral agreements filed with the KSBMA when renewing funeral establishment/branch establishment licenses.

 

#10-12–After reviewing correspondence: (Bedene-Holroyd) To close the file. Carried. Parties were notified of no violations. The complaint involves unprofessional conduct.

 

#10-13–After reviewing correspondence: (Bedene-Holroyd) To close the file. Carried. Parties were notified of no violations. The complaint involves the value of a prefinanced funeral agreement at-need.

 

#10-14–After reviewing correspondence and receiving an update of phone calls since the April 2010 meeting: (Bedene-Holroyd) To close the file. Carried. Parties were notified of no violations. The complaint involves the possibility of unlicensed activity of a yet-to-be licensed funeral establishment.

 

#10-15–After reviewing correspondence: (Bedene-Holroyd) To close the file. Carried. Parties were notified of no violations but to notify the funeral director that better communication may have avoided the situation from occurring. Carried. The complaint involves unprofessional conduct relating to at-need funeral arrangements.

 

#10-16–(Young-C. Smith) To adopt the recommendations of the Investigative Committee and close the file. Closed. The funeral director license of this individual was revoked for failure to notify the board of a prior conviction. The KSBMA web site section containing Board Actions will be appropriately updated.

 

#10-17–(Young-C. Smith) To adopt the recommendations of the Investigative Committee and close the file. Carried. The complaint involves a formerly licensed assistant funeral director/apprentice funeral director/funeral establishment owner who formed a company performing private autopsies in a Kansas hospital using an unlicensed physician to do so. Concerns with failure of complying with laws requiring transit permits for bodies transferred into and out of the State of Kansas. Information has been provided to the Kansas Board of Healing Arts.

 

#10-18–Young-C. Smith) To adopt the recommendations of the Investigative Committee and close the file. Carried. The complaint involves deceptive/fraudulent/misleading advertising of two formerly licensed assistant funeral directors on the funeral home’s web site.

 

#10-19–(Young-C. Smith) To adopt the recommendations of the Investigative Committee to close the file. Carried. The complaint involves concerns from a consumer regarding the amount of a refund from a cemetery. Information was forwarded to the Consumer Protection/Antitrust Division of the Kansas Attorney General’s Office for their review/consideration.

 

10-20–(Young-C. Smith) To adopt the recommendations of the Investigative Committee and close the file. Carried. The complaint involved failure of a licensee to file death certificates and return cremated remains to the family in a reasonable amount of time. The situation has since been resolved to the satisfaction of the family.

 

10-21–(Young-C. Smith) To adopt the recommendations of the Investigative Committee and close the file. Carried. The complaint involves the value of a prefinanced funeral agreement at-need. Clarification has been provided to the satisfaction of the consumer.

 

10-22–(Young-C. Smith) To adopt the recommendations of the Investigative Committee and close the file. Carried. The complaint involves advertising as posted on a funeral home web site that has since been appropriately revised to the satisfaction of all parties.

 

10-23–No action by the board necessary at this time.

 

10-24–(Young-C. Smith) To adopt the recommendations of the Investigative Committee to notify the licensee of appropriate changes needed in advertising and General Price List to remain in compliance with Kansas laws and the Federal Trade Commission’s Funeral Rule. Carried. The complaint involves advertising and inappropriate changes made to the funeral home’s General Price List. Should the funeral home provide these changes prior to the board’s letter being compiled, the letter will be adjusted accordingly.

                                                                                                                                                                                                                                                                                               

V.       Legislative Discussion

 

The board discussed the recent legislative session and bills affecting funeral service, including:

 

House Substitute for SB 75–A bill providing for certain enforcement actions by the Secretary of State relating to cemetery corporations that became law on April 15, 2010. Contains some of the information contained in HB 2713–which was not passed. Temporary regulation KAR 7-16-1 is now in effect and requires a $20 fee for each prefinanced cemetery merchandise agreement and burial/interment space in the State of Kansas as a means of financing enforcement of the provisions in the bill.

 

Senate Substitute for House Bill 2310–The KSBMA bill that will license individual crematory operators, set up licensure/renewal maximums, require certain training and continuing education, increases other fee maximums . . . among other things. Identical language originally in SB 506. The bill was effective upon publication in the Statute Book, July 1, 2010, but the provisions within the bill are not effective until July 1, 2011. The big challenge facing the administrative staff and board is to complete all appropriate regulations in the time frame out-lined in the bill.

 

HB 2454–Formerly SB 488 with some amendments. Concerns statistics from the Office of Vital Statistics (OVS) for medical research; the use of birth, death and still birth certificates for identification purposes; voluntary interview notification requirements, fingerprinting and criminal history record checks as a part of the application process for potential employees within the OVS. This bill was effective as of May 27, 2010.

 

HB 2486–Amends two sections of the Anatomical Gift Act of 2007. Formerly SB 391. Will amend the requirements of the statewide organ and tissue donor registry by including language that an individual, who agrees to have the individual’s name in the registry, has given full legal consent to the donation of any of the individual’s organs or tissues upon the individual’s death recorded in the registry. Amendments will also permit a donor to amend or revoke an anatomical gift by directly accessing the registry website or notifying the Kansas federally designated organ procurement organization to request the amendment or revocation. In addition, the withdrawal of the individual’s consent to be listed in the registry does not constitute a refusal to make an anatomical gift of the individual’s body or parts. The bill took effect July 1, 2010 upon publication in the Statute Book.

 

 Substitute for SB 475–The bill amends the definition of a funeral director and funeral services. The bill was requested by the Kansas Funeral Directors Association and will allow for individuals engaged with cremation for five (5) consecutive years to be exempt from serving a funeral directing apprenticeship and will allow them to be administered the funeral directors’ examination for up to 120 days from passage of this act. The bill was signed by Governor Parkinson and became law on July 1, 2010. One applicant, meeting the qualifications outlined in this bill, is meeting with the board at this meeting and has applied to be administered the written funeral directors’ examination later this afternoon.

 

HB 2588–Will increase the maximum amount of irrevocably funded prefinanced funeral agreements from $5,000 to $7,000. Requested by the KFDA. Signed by Governor Parkinson and became law on July 1, 2010.

 

HB 2589–Will require certain disclosures with prefinanced funeral agreements. Requested by the KFDA. Signed by Governor Parkinson and becomes law effective January 1, 2011. The provision that would have required notification from the bank to consumers was not a part of the final product.

 

The Kansas Department of Social and Rehabilitation Services (SRS) Funeral Assistance Program (FAP)–Due to massive State budget cuts, the FAP program will no longer be funded as of July 1, 2010. On June 9, 2010, a Funeral Assistance Meeting was held in the office of the Kansas Funeral Directors Association (KFDA.) In addition to the KFDA, members representing the Kansas Association of Counties (KAC) and the Kansas State Board of Mortuary Arts (KSBMA) were in attendance. The meeting was to discuss the many problems created with failure of funding the FAP. Items discussed included the FAP, related Kansas law (KSA’s 22a-215, 65-901 et seq., 65-1734), the University of Kansas Willed Body Program and issues including what constitutes an unclaimed body, responsibility of death and how to go forward. While no final conclusions were made, the group agreed that how each county would qualify a death would need to be addressed as well as an amount of funding to go with qualified applicants.

VI. Board Business:

 

             1)     (Young-Bedene) To approve the quarterly lists of continuing education (CE.) Carried. One list contains correspondence/home study programs. Both of these lists of approved continuing education programs are regularly updated and are available on the board’s web site on the internet and are mailed to licensees not having internet access on a quarterly basis.

             2)     (Bedene-Young) To approve the list of lapsed licenses as amended. Carried. The list is a part of these minutes and contains the names of individuals whose license renewals are past due for longer than six months, who have requested that their licenses be dropped, who have died or in the case of assistant funeral directors are no longer employed at a funeral home under the supervision of a funeral director. The list included twelve (12) assistant funeral director licenses, one (1) funeral director license, and one (1) embalmer license. Information is provided for a number of reasons, including use by the Office of Vital Statistics (OVS) for purposes of licensure verification as used on death certificates.

             3)     The board reviewed the list of automatically suspended licenses. This list contains the names of individuals who have not paid their license renewal fees by the appropriate due date and have not requested that their licenses be dropped. Once a license is six months in arrears, it is then automatically placed on the lapsed license list for purposes of being dropped. This list included six (6) embalmer licenses and three (3) funeral directors with renewals due through June 30, 2010.

             4)     (C. Smith-Young) To approve the FY 2010 fourth quarter (April 1-June 30, 2010) and FY 2010 Final Reports of Funeral Home/Crematory Inspector, Francis F. Mills. Carried. 147 inspections were conducted during the quarter including five (5) violations relating to display licenses and preparation room issues. For FY 2010, 672 inspections of funeral homes and crematories were conducted covering 26,944 miles, with three (3) new funeral establishments, two (2) branch funeral establishments. There were a total of 23 violations.

             5)     Reviewed the current roster of apprentice embalmers and funeral directors. A total of 23 apprentices are currently registered with the board at this time, including: twelve (12) embalmer-funeral directors, three (3) embalmers and eight (8) funeral directors.

             6)     Discussion of news articles relating to the funeral profession that has been provided to board members and legal counsel for their review.

             7)     A reminder of the final regularly scheduled 2010 board meeting date: October 14, 2010.

             8)     (C. Smith-Bedene) To approve regularly scheduled 2011 board meeting dates. Carried. Dates approved are: January 13, April 14, July 14, and October 13, 2011.

             9)     The board signed travel vouchers.

           10)     The board discussed the Patriot Act and how the Act has effected how funeral homes are able to work with families opening new prefinanced funeral agreements via trusts at financial institutions. Two (2) funeral homes in the same town have contacted the KSBMA to say that both local banks will not allow them to open up trusts for consumers unable to meet requirements of two forms of photo identifications. No one in attendance had run into a similar situation–as two forms of identification, such as a Social Security card and Medicaid card, were the requirements of the banks utilized by the licensed board members.

                                                                                                                                                                                                                                                                                                

VII.     Executive Secretary's Report:

 

            1)      Budget Update

a) Expenditures for FY 2010 (July 1, 2009 through June 30, 2010) were approximately $234,752. With an expenditure limit of $270,191, expenditures for FY 2010 were approximately $35,440 (12.2%) under budget with remaining funds transferred to the KSBMA fee fund for future use. There was a 5% salary reduction for the executive secretary for the remaining portion of FY 2010. That reduction was reinstated by Governor Parkinson (via his line item veto of the bill) effective in FY 2011.

b) The legislature and Governor approved an FY 2011 (July 1, 2010 through June 30, 2011) budget of $271,510. This figure does not include costs for the Under Market Allocations $1,757 for one classified position or the KPERS Death and Disability Moratorium for one quarter of the FY.

c) The KSBMA budget request for FY 2012 and FY 2013 is due to be submitted to the Division of the Budget (DOB) by September 15, 2010.

d) The Investigative Committee will take the first step in going paperless beginning with information leading up to the October meeting. While paper will be provided for this meeting, information will be provided electronically also with the goal being for the Investigative Committee to go paperless with the January 2011 meeting if things go as planned during the upcoming three (3) month trial period–in an effort to decrease costs involving paper.

            2)      Updated information regarding the International Conference of Funeral Service Examining Boards (ICFSEB).

a) The board reviewed a report provided by Exec. Sec. Smith of the Annual Conference he previously attended.

            3)      Updated information on the Council on Licensure, Enforcement and Regulation (CLEAR) was discussed.

            4)      Updated information regarding the Federation of Associations of Regulatory Boards (FARB.)

            5)      Updated information on the Kansas Funeral Directors and Embalmers Association (KFDA.)

a) Mr. Smith represented the board at the KFDA’s 2010 Spring Regional Meetings at four (4) locations around the state and provided the board with a report of such.

b) The board’s staff was able to attend portions of the Tri-State Convention in Overland Park–although Executive Secretary Smith missed the final 11/2 days due to legislative activities at the State Capitol. A report of convention activities was provided by Exec. Sec. Smith.

c) Exec. Sec. Smith will co-present the two (2) hour continuing education program at the upcoming KFDA Fall 2010 District Meetings. He will also provide a Board Update during the business portion of the meetings.

            6)      New/updated information located on the board’s Web Site, which can be found at: http://www.kansas.gov/ksbma/.

a) There were 52,737 successful requests on the KSBMA web site for the month of June 2010.

b) Kansas.gov continues to work on setting up the entire KSBMA renewal process, KanPay, so that it will be able to be performed on-line. The administrative staff continues to meet with representatives during the process. While no immediate completion date has been finalized, there is no cost to the KSBMA for the project. Currently, license renewals can be paid on-line but are not final until all paperwork has been filed with the board.

           7)       The board discussed information pertaining to the National Funeral Directors Association (NFDA).

           8)       Updated information from the Federal Trade Commission (FTC) regarding the Funeral Rule was discussed.

            9)      Updated information from the American Board of Funeral Service Education (ABFSE.)

a) The ABFSE is in the process of hiring a replacement for Dr. Michael Smith with a September 15, 2010-deadline for applications.

          10)     Updated information from the Cremation Society of North America (CANA)

a) The board extends their appreciation to CANA for their support in the writing of Senate Substitute for House Bill 2310, including Jim Wylie, Rick Wiseman and Mike Nicodemus.

          11)     Updated information from the Funeral Ethics Association (FEA).

          12)     Updated information from the Funeral Consumer Alliance (FCA).

          13)     Updated information from the Funeral Consumer’s Alliance of Greater Kansas City.

          14)     Updated information from the Funeral Ethics Organization (FEO).

a) An FEO brochure, “Prepaying Your Funeral in Kansas” was reviewed and discussed with no action taken.

          15)     Updated information from the American Society of Embalmers (ASE.)

a) The ASE Annual Meeting and Conference was held on June 11, 2010 in Wheeling, Illinois. Due to budgetary restraints, Exec. Sec. Smith was unable to attend.

          16)     Updated information from the Kansas Department of Health and Environment (KDHE), Office of Vital Statistics (OVS.)

          17)     Updated information from the Kansas City Kansas Community College (KCKCC) Mortuary Science Program.

a) Executive Secretary Smith provided an update on the KCKCC Advisory Board Meeting of May 12, 2010.

          18)     Kansas Mass Fatality Planning Task Force

          19)     SMART/FMS Update–The new financial management system of the State of Kansas which was implemented July 1, 2010 for FY 2011

a) Mr. Smith provided an update on the training process used for SMART and how things have gone since implementation of the program on July 1, 2010.

          20)     An amended Roster of Board Member Appointments was provided.

VIII.    Board Interviews with Applicants for Licensure:

 

Embalmer-Funeral Director Applicant: Ms. Cassandra J. Woods-Morgan

 

(Bedene-Young) To extend the embalming apprenticeship of Ms. Woods-Morgan with completion to be reviewed and considered at the October 14, 2010 regularly scheduled board meeting and to grant a funeral director license upon passing the written funeral director examination, which will be administered later today, and payment of an initial license fee of $32.00. Carried. Ms. Woods-Morgan completed her funeral directing apprenticeship at Bowser-Johnson Memorial Chapel in Topeka, Kansas on June 3, 2010. She served the greater portion of her apprenticeship at Mrs. J.W. Jones Memorial Chapel in Kansas City, Kansas. Once issued, the renewal date for the funeral directing license would be November 30, 2011. She attended Donnelly College in Kansas City, Kansas, and Kansas City Kansas Community College in Kansas City, Kansas where she earned an Associate in Applied Science (AAS) Degree in Mortuary Science. Mr. Smith will provide the necessary paperwork to the apprentice and supervising embalmer/embalmers and either he and/or KSBMA Funeral Home-Cemetery Inspector Mills will observe the apprentice embalm at least once prior to the October meeting.

                                                                                                                                                                                                                                                                                                 

Embalmer-Funeral Director Applicant: Ms. Bridgette A. (Tharp) Tinsley

 

(Young-C. Smith) To grant an embalmer license upon completion of apprenticeship, payment of an initial license fee of $91.00 and to grant a funeral director license upon completion of apprenticeship, passing the written funeral director examination, which will be administered later today, and payment of an initial license fee of $26.00. Carried. With continuous employment, Ms. Tharp is scheduled to complete her embalming and funeral directing apprenticeships at Carlson-Geisendorf Funeral Home and Crematory in Salina, Kansas on August 4, 2010. She served the greater portion of her apprenticeships at Davis Funeral Chapel in Leavenworth, Kansas. Once issued, the renewal date for both licenses would be August 31, 2011. She attended Kansas State University in Manhattan, Kansas, and Kansas City Kansas Community College in Kansas City, Kansas where she earned an Associate in Applied Science (AAS) Degree in Mortuary Science.

                                                                                                                                                                                                                                                                                                

Embalmer-Funeral Director Applicant: Mr. Michael G. “Mike” Rorabaugh

 

(Young-Bedene) To grant a funeral director license upon completion of apprenticeship, passing the written funeral director examination, which will be administered later today, and payment of an initial license fee of $46.00 and to extend the embalming apprenticeship with completion to be reviewed and considered at the October 14, 2010 regularly scheduled board meeting. Carried. Mr. Smith will provide the necessary paperwork to the apprentice and supervising embalmer/embalmers and either he and/or KSBMA Funeral Home-Cemetery Inspector Mills will observe the apprentice embalm at least once prior to the October meeting. Carried. Upon continuous employment, Mr. Rorabaugh is scheduled to complete his funeral directing apprenticeship at Old Mission Mortuary in Wichita, Kansas on August 26, 2010. Once issued, the renewal date for the funeral director license would be June 30, 2011. Mr. Rorabaugh attended Wichita State University in Wichita, Kansas and earned an Associate of Applied Science (AAS) Degree at the Dallas Institute of Funeral Service in Dallas, Texas.

                                                                                                                                                                                                                                                                                                 

Embalmer Applicant: Ms. Rachael E. Hall

Smith-Young) To grant an embalmer license upon completion of apprenticeship and payment of an initial license fee of $49.00 and to grant a funeral director license upon completion of apprenticeship, payment of an initial license fee of $14.00 and passing of the written funeral director examination, which will be administered later today. Carried. Ms. Mardis is scheduled to complete her apprenticeships on July 28, 2010 at Prairie Rose Funeral Homes in Harper and Anthony, Kansas. Once issued, the renewal date for the licenses would be January 31, 2011. Ms. Mardis attended Cowley County Community College located in Arkansas City, Kansas, and earned an Associate in Applied Science degree in Mortuary Science at Kansas City Kansas Community College in Kansas City, Kansas.

                                                                                                                                                                                                                                                                                                    

Embalmer-Funeral Director Applicant: Rev. Dr. Curtiss P. Davis

 

(Young-Bedene) To grant an embalmer license upon payment of an initial license fee of $154.00 and to grant a funeral director license upon payment of an initial license fee of $44.00 and passing of the written funeral director examination, which will be administered later today. Carried. Rev. Dr. Curtiss served his apprenticeships at Price and Sons Funeral Home in Garden City and at Fitzgerald Funeral Home in Ness City, Kansas. Once issued, the renewal date for the licenses would be April 30, 2012. Rev. Dr. Davis attended Bellevue University located in Bellevue, Nebraska, and earned an Associate in Applied Science degree in Mortuary Science at Kansas City Kansas Community College in Kansas City, Kansas. His road from school to licensure has been a long one, and the Board congratulated the applicant on his perseverance and desire for licensure as a funeral professional.

Funeral Director Applicant: Ms. Terry L. Roberts

 

(Young-C. Smith) To grant a funeral director license upon payment of an initial license fee of $114.00 and passing of the written funeral director examination, which will be administered later today. Carried. Pursuant to Substitute for Senate Bill 475, Ms. Roberts has lawfully engaged in the business of providing cremation services in Kansas for five consecutive years prior to July 1, 2010–exempting her from the apprenticeship requirements which are a prerequisite for licensure as a funeral director. Once issued, the renewal date for the license would be June 30, 2011. Ms. Roberts attended Brookhaven College located in Dallas, Texas, Southwestern College located in Winfield, Kansas, Salt Lake Community College located in Salt Lake City, Utah and earned an Associate of Arts in Natural Science, Mathematics and Biology Degree at Kansas City Kansas Community College in Kansas City, Kansas. Ms. Roberts is the owner-operator of the Midwest Cremation Society operating out of Topeka, Kansas, a business currently not licensed with the KSBMA.

                                                                                                                                                                                                                                                                                                      

Reciprocal (Illinois) Embalmer-Funeral Director Applicant: Ms. Bonnie M. Wehrman

 

(Young-Bedene) To grant a reciprocal embalmer license upon payment of a $112.00 initial license fee and to grant a reciprocal funeral director license upon payment of a $152.00 initial license fee and passing the written funeral director examination, which will be administered later today. Carried. The renewal date for the licenses would be November 30, 2011. Ms. Wehrman was granted (Illinois) embalmer and funeral director licenses on May 13, 2008. She attended Kishwaukee College located in Malta, Illinois, and earned an Associate of Applied Science Degree in Mortuary Science at Worsham Community College of Mortuary Science located in Wheeling, Illinois. She has passed the national examination administered by International Conference of Funeral Service Examining Boards and is employed at Charter Funerals in Great Bend, Kansas.

                                                                                                                                                                                                                                                                                                        

Reciprocal (Florida) Embalmer-Funeral Director Applicant: Mr. David M. Speakman

Smith) To grant a reciprocal embalmer license upon payment of an $84.00 initial license fee and to grant a reciprocal funeral director license upon payment of a $114.00 initial license fee and passing the written funeral director examination, which will be administered later today. Carried. The renewal date for the licenses would be July 31, 2011. Mr. Speakman was granted (Florida) funeral director/embalmer licenses on August 13, 2008. He attended DuPage College located in Glen Ellyn, Illinois where he earned an Associate of Arts Degree and graduated from Worsham College of Mortuary Science located in Skokie, Illinois. Mr. Speakman passed the national examination administered by International Conference of Funeral Service Examining Boards. Mr. Speakman is an assistant funeral director and is employed at Penwell-Gabel Funeral Home and Crematory, Johnson Chapel in Junction City, Kansas.

Carried. The renewal date for the licenses would be July 31, 2011. Mr. Spomer was granted a Missouri embalmer license on March 18, 2008 and a Missouri funeral director license on March 13, 2006. He earned an Associate in Applied Science degree in Resort Management at Colorado Mountain College and earned an Associate in Applied Science Degree in Mortuary Science at Kansas City Kansas Community College.
