The 2009-2010
Kansas Legislature Updated
5-17-2010
The 2009-2010 Kansas Legislature recessed on Tuesday,
May 11, 2010 and will return for
Sine Die on Friday, May 28, 2010 when both the Senate and
House will reconvene at 10:00 a.m.
House Substitute
for Senate Bill 75 This bill now deals with
cemetery
corporation accounting, cemetery permanent maintenance fund and the
cemetery merchandise trust fund by authorizing the Attorney General to
initiate action at the request of the Secretary of State when deemed
necessary. The substitute bill passed the House, 118-1, and
Senate, 40-0, was approved by the Governor, and became law on April 15,
2010 when the bill was published in the Kansas Register.
Senate Bill 87
A bill makes changes to the Kansas Administrative Procedure
Act (KAPA) involving disclosure of certain records, administrative
procedure and judicial review. How licensure agencies, such as
the KSBMA, prosecute cases. The bill was amended and passed the
Senate, 39-1. The House Judiciary Committee amended the bill,
and it passed the House as amended, 125-0. On 3/25/09 the bill
went to conference committee. 4/1/09 the House adopted the
Conference Committee Report, 124-0. 4/2/09 The Senate adopted the
conference committee report, 39-0. The bill was approved by
Governor
Sebelius on April 20, 2009 and became law on July 1, 2009.
Substitute for
Senate Bill 475
A bill introduced at the request of the Kansas Funeral Directors
Association (KFDA) defining
funeral services,
for the purpose of regulating funeral directors. The bill would
amend KSA 2009 Supp. 65-1713 and would repeal the existing
section. The Senate Public Health
and Welfare Committee amended some of the bill's language, including
allowing an exemption for funeral director applicants relating to
apprenticeship and amending further the definition of a funeral
director relating to funeral services. It passed the Senate, 40-0
as amended, and was
referred to the House Health and Human Services Committee who held a
hearing and recommended the bill be passed as amended. The bill
passed the House as amended, 118-4 with the Senate concurring with the
House amendments, 40-0. It was enrolled by the Senate, signed by
Governor Parkinson, and will become law upon publication in the Statute
Book: July 1, 2010.
House Bill 2201
A bill concerning conditions on professional licenses if delinquent in
child support. The bill was amended and passed the House, 114-5,
and passed the Senate, 40-0 and was approved by the
Governor on 4/6/09 and became law on July 1, 2009.
Senate Substitute for House Bill 2310
The
Substitute Bill passed the Senate, 37-3 but the House
nonconcurred. A Conference Committee was appointed with House
Committee Members: Bethel, Hill and Williams, and Senate
Committee Members: Barnett, V. Schmidt and Kelly. The bill
passed out
of Conference Committee and was concurred by the House, 99-24.
The
House enrolled the bill and presented it to Governor Parkinson for his
consideration on 5/7/2010.
On
Thursday, May 13, 2010, Governor Mark Parkinson announced the
signing of several bills, including:
Relating
to crematory operations--
Senate Substitute for House Bill 2310 enacts new law creating licensure
requirements for crematory
operators, increases the statutory maximum for certain fees charged by
the Kansas State Board of Mortuary Arts and makes several amendments to
laws governing the cremation process. Among the new requirements, the bill will:

Require
that every cremation conducted in Kansas be under the supervision of a
licensed crematory operator;
Make it unlawful for
any person to engage in the business of crematory operator without a
license;
·
Require
that every person desiring to enter the practice of crematory operator
apply to the Board of Mortuary Arts and meet the requirements of the
Board concerning age and training; and
·
Establishes
a renewal fee for licensure.
In
addition, the bill establishes a new
definition of cremation and requires the consent of the next of kin
when a crematory intends to recycle anything remaining after cremation.
The bill takes effect upon its publication in the Kansas Statute Book
with the actual laws effective July
1, 2011.
House BIll 2454
Involves the Kansas Department of Health and Environment (KDHE)/Office
of Vital Statistics (OVS). Items covered, involve statistics to
be used for medical research; the use of birth, death and still birth
certificates for identification purposes; voluntary interview
notification requirements, fingerprinting and criminal history record
checks as a part of the application process for potential employees
within the OVS . . . Takes effect upon publication in
the Kansas Register.
House BIll 2486
Amends two sections of the Anatomical Gift Act of 2007. The billl
amends the requirements of the statewide organ and tissue donor
registry by including language that an individual, who agrees to have
the individual’s name in the registry, has given full legal consent to
the donation of any of the individual’s organs or tissues upon the
individual’s death recorded in the registry. Amendments will also
permit a donor to amend or revoke an anatomical gift by directly
accessing the registry website or notifying the Kansas federally
designated organ procurement organization to request the amendment or
revocation. In addition, the withdrawal of the individual’s
consent to be listed in the registry does not constitute a refusal to
make an anatomical gift of the individual’s body or parts. The
bill will take on July 1, 2010 upon publication in the Statute Book.
House Bill 2588 A
bill introduced at the request of the KFDA
that would increase the maximum limitation on irrevocable prefinanced
funeral agreement funds from $5,000 to $7,000. HB 2588 Supplemental Note
The bill would
amend KSA 16-303 and repeal the existing section. The bill passed the House, 122-0, and also
passed the Senate, 40-0. The bill was signed by Governor
Parkinson and will become law July 1, 2010.
House Bill 2589
A bill introduced at the request of the KFDA that add disclosures on
prefinanced funeral agreements. The bill was amended eliminating the
requirement of notification by financial institutions and passed the
House as amended, 122-0, and also passed the Senate, 40-0. The bill was signed by Governor Parkinson
and will become law July 1, 2010.

Assistance Program--Due
to budget cuts within the State of Kansas, this program was not
budgeted as of July 1, 2010.
