A: A resident agent is an individual or another entity that has the responsibility for accepting service of process on behalf of a business entity. A resident agent can be an individual, or other entities as provided in Kansas law.

A: A registered office is the physical, Kansas address where the resident agent is located for service of process (lawsuits). The registered office may not be a PO BOX (or other variation), it may only be a street address, rural route or highway address in Kansas.

A: Under Kansas law only certain types of entities may act as another entity's resident agent. Aside from other business entities, an individual may also serve as an agent. Please consult with your attorney or review Kansas law for more information.
Corporations (domestic and professional) are allowed to have the following entity types as their agent: a Kansas or foreign corporation, a Kansas or foreign limited liability company, a Kansas or foreign limited partnership, a Kansas or foreign business trust, or the entity itself with a Kansas address.

A: The legal name of an individual is required for a resident agent. The online filing system requires that a legal name contain a full first name (not just an initial) and full last name. If the resident agent wishes to use initials, they must provide the initial of the first name and the initial of the middle name along with the full last name. If the resident agent's legal name is one word or only one letter and does not have a middle name then you will need to file by paper and provide proof of legal name.

A: Our office does not maintain a list of resident agents. You may wish to contact your attorney for a suggestion, or search the yellow pages or internet for a service company that will act as your resident agent.

A: Please ensure that you have each component of your address in the appropriate fields. Please also ensure that you are not using an abbreviation of your address, you may wish to use an online map search, such as Map Quest to verify your address. If your address has recently been created by your city or county in the last six months our online database may not be updated with this new address. If you continue to have difficulties please contact the Office of the Kansas Secretary of State for assistance, (785) 296-4564.

A: Once you submit payment, a screen will appear providing you a link to print the certified/filed stamped copy of your filing as well as an official cover letter acknowledging your filing. The certified document that you print is your official filing.

A: The information is transmitted from Kansas.gov to the Office of the Kansas Secretary of State at the top of each hour. Once the Secretary of State's office receives the filing information it will appear back out on the web search within 30-45 minutes.

A: The online filing system in Kansas is real-time, 24/7 providing immediate filings. You may perform your online filing any day of the week, at any time including holidays. The filing will be accepted immediately and you will be provided the certified/file stamped document and cover letter after submitting payment. The information will then be available on the online business entity search within 1-2 hours.

A: There are a couple of possible reasons this is happening; you may have stepped away from your computer for too long and you were timed out of the system - this typically happens if you leave the filing page open for more than 20-30 minutes, or this could also indicate that your cache file is storing or remembering actions that your computer took when you first attempted the filing - now, every time you come to that same page or click on that same button your computer is remembering the action it took the first time, which may have sent you back to the beginning of the application. You may wish to empty your cache file or seek assistance from your computer technician. If you continue to experience difficulty with this situation, it is most likely not an error within the filing application but within the settings on your computer. You may file by paper or attempt to file on a different computer.
